Terms of Service

The following are the general Terms of Service of the services provided by WEBDPORT, NTYNK Rewards Etrades Network (WEBDPORT) of www.bestevertry.com for its CLIENTS (CLIENT).

TIME FRAME AND RESPONSIBILITIES

• The official estimated completion date is stated in the e-contract provided by WebDPort for Client. WebDPort will make every effort to meet the agreed due date. Client should be aware that failure to submit required information or materials may cause subsequent delays in the production and significant delays in delivery of the finished work. Hence, Client must be cooperative and provide prompt feedback throughout the Services process.
• No compensation for any loss or damages caused by the delay in completion of the Services.

 

EXCLUSIONS

• What are not included in the web design and development plans: domain name registration, web hosting, graphic design (e.g. logo design) and web maintenance services.

 

EMAIL & WEB HOSTING AND DOMAIN NAME

• The designed web pages are required a domain name and hosted on the web hosting for publishing the web content to the Internet. The designed web pages of the web design and development plans will be hosted by client’s own web hosting provider with the domain name of choices (http(s)://www.yourdomain.com). WebDPort provides the original web design by receives a one-time fee.
• If client add-on shared web hosting and domain name registration (http(s)://www.yourdomain.com) services by ordering WebDPort web design plan as a package, WebDPort will arrange and include a reliable & trustworthy hosting package that provided by our affiliate partners. Once client subscribes those services, the client is not limited to agree and accept the terms & conditions of WebDPort, but also the terms & conditions of the service provider, our affiliate partners.
• The Yearly Fee is required for those services, which is payable to the web hosting and domain name services provider and as a website maintenance fee payable to WebDPort.
• There is another option for the client to host the designed web pages, which is hosted on WebDPort server, The website domain will be WebDPort subdomain, (https://www.bestevertry.com/yourbusiness). Client no need to get own web hosting/domain provider and no yearly fee is required. To keep it free, WebDPort is reserve the rights to insert unobtrusive ads.

 

PAYMENT

• One Page Plan, Standard Plan, Advanced Plan, Logo Design and others: Full payment is required prior to the commencement of work.
• Tailored-Made Plan: A 50% deposit is required prior to the commencement of work.

 

REFUND POLICY

• All payments (including deposit) made by Client are NONREFUNDABLE.

 

LOSS OR DAMAGES

• No compensation for any loss or damages caused by the Services provided by WebDPort for Client.

 

DESIGN AND DEVELOPMENT CREDIT

• Client agrees that WebDPort may put a byline on the bottom of the website, establishing design and development credit with an active hyperlink to WebDPort’s website.
• Client also agrees that the website created by WebDPort for Client may be included in WebDPort’s portfolio and its affiliates and partners.
• Client agrees that the website will involve in WebDPort Marketing & Advertising Campaign and agree WebDPort use the website for publicity purpose which includes but are not limited to WebDPort’s and its partners’ website, social media pages, promotional and commercial campaigns.

 

RESERVATION OF RIGHTS

• All rights not expressly granted hereunder are reserved to WebDPort, including but not limited to all rights in sketches, comps, or other preliminary materials.

 

CONTENT AND COPYRIGHT

• Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to WebDPort for inclusion in Client’s website are owned by Client, or that Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend WebDPort from any claim or suit arising from the use of such elements as furnished by Client.
• It is Client’s responsibility to proofread the content of the website and review all work provided by WebDPort.

 

CHANGES

• All terms of service and prices are subjected to change without notice.

 

PERMISSIONS AND RELEASES

CLIENT AGREES TO INDEMNIFY AND HOLD HARMLESS WEBDPORT AGAINST ANY AND ALL CLAIMS, COSTS, AND EXPENSES, INCLUDING ATTORNEY’S FEES, DUE TO MATERIALS INCLUDED IN THE WORK AT THE REQUEST OF THE CLIENT FOR WHICH NO COPYRIGHT PERMISSION OR PREVIOUS RELEASE WAS REQUESTED OR USES WHICH EXCEED THE USES ALLOWED PURSUANT TO A PERMISSION OR RELEASE.
